Notice and Takedown Policy

Intellepedia is engaged in curation and hosting of Intellectual Property (IP) News contents for the benefit of persons with visual disabilities and other disabilities. Intellepedia places high emphasis on respecting and protecting right holders’ intellectual property against infringement and hence takes due care to make the contents available in good faith. Pursuant to the Terms and Conditions every user agrees to conduct activity that is lawful on the Website. However, despite these safeguards, materials published from time to time may be in breach of copyright of right holders or may include content that may be regarded as obscene or defamatory.  If such contents on our Website concern you or for which you have not given permission, or is in violation of copyright law and not subject to any limitation or exception, contact us in writing stating the following:

  1. Your contact details including but not limited to name, address, telephone number, and email address.
  2. Detailed description of the alleged Infringement/work. This includes identification of infringing work(s), location of the infringing work(s) further it should include URL where the infringing content is available or a copy of it to make a reasonable determination.
  3. If the request relates to copyright, provide proof that you are the rights holder or the authorised representative.
  4. An undertaking to file an infringement suit upon failure to it takedown within 21 days of receipt of the notice.

Notice and Takedown Procedure

Intellepedia upon receipt of takedown notice, shall review and investigate the notices of alleged Infringement and determine whether the contents violate copyright of the complainant copyright holder and if the notice provided is in satisfaction of Information Technology Act, 2000 and Copyright Rules, 2013. Intellepedia being satisfied from the details provided in the complaint/ notice that the copy of the work is infringing, will respond by removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity. In certain cases like the user- generated contents, it shall inform the alleged infringer of receipt of takedown notice and provide the infringer an opportunity to respond to takedown notice.
